QBD 10 June 1997. SoS Transport made a proposal within the Land Compensation Act 1962 s22(2) to acquire parcels of land owned by the two plaintiffs (F). Following an application, the local planning authority issued certificates for appropriate alternative development. Negative certificates were subsequently issued by E, adopting the date of entry as the relevant date for foreseeable planning policies. F contended that the relevant date is that when the original proposal was made. E`s decision quashed.
