The claimants found the enjoyment of their properties severely affected and the values diminished. At about the same time as the highway works were undertaken, an order was made prohibiting heavy goods vehicles in excess of 3 tonnes from using the junction. The claim was dismissed on the basis that the difference between the pre and post road works was very limited, if the works had not been carried out it was reasonable to assume that the total traffic would have grown, and it had not been established that the use of the altered junction had caused physical factors which would not otherwise have occurred.
