The plaintiffs purchased a house on land which consisted partly of soap waste. In 1985 a constant trickle of water from the defendant`s sluice valve caused water to collect outside the plaintiff`s property. In November the water supply ceased altogether, was restored but the gas supply also ceased and the plaintiff was forced to evacuate due to a gas leak. The Gas Board and Water Authority carried out extensive repairs outside the plaintiff`s home resulting in the pavement and one wall of their home collapsing. Thereafter substantial subsidence occured and in October 1986 the plaintiffs were forced to leave the house. The plaintiffs claimed against the defendants under Water Act 1981 s6 for the damage they alleged was caused by the escape of water. They also brought their claim in nuisance in respect of the escape of a dangerous thing from the land of the defendant.
