QBD 5 March 1998. Landlord N appealed against an assessment by C on fair rent for eight flats. N had provided evidence of two lettings which C adjusted for modernisation and scarcity. N contended that C had not had regard for the decision in "Spath Holme Ltd v Greater Manchester and Lancashire Rent Assessment Committee", to which C conceded. The decision to be remitted for redetermination by a different committee.
