Recently the courts have considered the operation of the short-term lease exclusion in s43(3), in the case of "Cricket Ltd v Shaftesbury plc". The decision being that a period of occupation after the expiry of an excluded tenancy could not retrospectively bring earlier tenancies within the protection of the Landlord and Tenant Act 1954.
