The plaintiff (S) held a tenancy of business premises which expired on 28 September 1997. On 25 February 1998, the defendant landlord (B) gave notice determining the tenancy, stating that a new tenancy would be opposed. S gave up possession before the contractual term date, and subsequently claimed compensation for disturbance of twice the rateable value. B claimed that S had not been in occupation for a sufficient time. "Held" S not entitled to compensation of twice the rateable value, since they had given up possession by the contractual term date.
