On 3 August 1999 Docklands Estates Ltd (appellent) was convicted of three offences contrary to the Trade Descriptions Act 1968 s13. The prosecution claimed the appellent estate agent company had been engaged in 'fly boarding', which involves erecting 'sold' signs on properties without the owners permission. The appellent was fined £7,500 on each count to be paid within 28 days. The appellent attempted to appeal against the conviction 52 days after the appeal time limit had expired. An extension of time was not granted and the CA decision was only concerned with the appropriateness of the fines. Appeal allowed in part. Fines reduced to £2000 for each of the three offences. Judge considered that fines imposed by magistrates for similar offences under the Town and Country Planning Act are £100 for each offence, and thus for fines to be effective, they must be realistic.
