Evaluates the impact of "R v SoS Environment ex parte Holding and Barnes plc" and "R v SoS Environment ex parte Premier Leisure" challenging the SoS's call in powers as a breach of human rights with regard to listed buildings and ancient monuments. Notes that the appeals process does not comply with Article 6 of th European Covention as it is decided by the SoS and that, as a consequence, decisions on listing and scheduling could be challenged under human rights.
