D applied for an adjournment on the grounds that the order contravened her right to respect for her private and family life and her home, under the European Convention of Human Rights Articles 6 and 8. D also contended that this involved interpreting the Housing Act 1988 s21(4) in a way that was incompatible with the Human Rights Act 1998..
