Heathrow night noise breaches human rights

Held that the increase in the noise level caused by aircraft using Heathrow airport at night was a breach of the applicants' right to respect for their private and family lives and their homes as guaranteed by the European Convention on Human Rights Article 8. Secondly, it was held that the right to an effective remedy as guaranteed by Article 13 of the Convention had also been breached in that the judicial review carried out by the English courts was not sufficient to comply with that article. In the light of the ruling the UK Government is expected to carry out a further review of night flights but is expected long term to put the ruling into effect.
