Recommends that landlords and their advisers consider the implications of the Unfair Terms in Consumer Contracts Regulations 1999 when drafting leases. Office of Fair Trading "Guidance on unfair terms in tenancy agreements" OFT356 November 2001 encourages movement away from the use of language a lay person would find unintelligible. Citing various cases and acts it warns that the 1999 Regulations will be used by tenants in their disputes with landlords.
