No agreement was reached as to the terms of the acquisition and the matter was referred to a leasehold valuation tribunal (LVT). This valued the property as at February 2000. Both parties appealed against the valuation to the LT which upheld the LVT finding as to the correct valuation date. W appealed contending that the correct valuation date was in fact May 1999. The appeal was dismissed with the valuation date being established as February 2000.
