Courts' review of completion
Series: Civil Engineering Surveyor ; December/January 2003, 24(1)Publication details: 2003Subject(s): Summary: Reviews the concept of practical completion, for which there is a clause in most standard forms of construction contract, in the light of "Skanska Corporation Regions Ltd v Anglo-Amsterdam Corporation" TCC (see a121203 for full report) where JCT WCD 1981 was employed. In this case the parties disputed the date by which the contractor had achieved practical completion. It was decided on appeal in TCC in favour of Skanska, practical completion being 'deemed' to have taken place at the earlier date. The judgment centred on the interpretation of cl17. Suggests that JCT should amend cl17 following this decision and examines the ICE Conditions of Contract 7th Edition cl48(3) to see how it could be affected.| Item type | Current library | Call number | Copy number | Status | Barcode | |
