[2004] EWHC 2353 (Ch), 8 October 2004. Discussed whether a arbitrator's award should be reconsidered on the grounds that he had departed from the agreed basis upon which the case was put to him. S appealed for reconsideration under the Arbitration Act 1996 s68 argued that the discount for onerous lease terms the arbitrator had applied was not part of the submission and that, if it had been S would have argued that the terms had already been taken into consideration. "Held": the application was allowed and the award remitted to the arbitrator.
