An adjudicator decided the dispute over an underpayment but Boston (M) argued that JCT 98 was not included in the contract and therefore no adjudication could apply. The case went to the Court of Appeal where the judge held that the parties had agreed to contract on JCT98 and that, as a consumer, (M) was not outside the adjudication rules and therefore was not protected as such by the Unfair Terms in Consumer Contracts Regulations 1999.
