Considers the effect of the Town and Country Planning (General Development Procedure) (Amendment) (England) Order 2006 (L134822) which after 10 May 2006 brings the construction of retail mezzanine gross floorspace of more than 200 sq m within planning control. The amendment puts to rest concerns over the unrestricted construction of mezzanines and local planning authorities now have tighter control over the expansion of retail floorspace. Certificates of lawfulness of the proposed use or development of mezzanines issued before the 10 May are ineffective unless they are implemented before that date.
