In September 1990 the plaintiff landlord (I) and defendant tenants (W) entered into an agreement for lease of public house premises. N had previously supplied figures on past barrelage although W agreed they had not entered into agreement based upon these. During the tenancy the barrelage did not meet figures for previous years. In May 1993 N commenced proceedings for possession and rent arrears. W counterclaimed for misrepresentation alleging barrelage overstated by N in order to induce the lease. Held counterclaim dismissed. W had not relied on N`s representation in agreeing to the lease.
