LCA 118 2006, 5 September 2007. The claimant company (G) sought compensation from the respondent council (W) for what it argued was compulsory purchase of land. The land in question had a history of different developments and owners dating to the nineteenth century. Planning permission was sought for the rebuilding of certain properties but had not been granted when G purchased the land. W was subsequently authorised to acquire G's interest in the land as a compulsory purchase and G claimed compensation on the grounds that planning permission for the developments had been expected. "Held": Planning permission capable of implementation was assumed for the rebuilding of the buildings previously on the site. There was no reason for not giving effect to this assumption. G was entitled to compensation on grounds that this rebuilding now could not take place. Compensation assessed accordingly.
