Examines the protection of employees' rights upon changes affecting their employer. The Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE Regulations) oblige employers to inform and consult employee representatives upon a relevant transfer. Examines the test applied to determine whether such a transfer has taken place. The standard TUPE test arises on transfer of an undertaking or business which retains its identity within the UK. Since 2006 a new TUPE test has included service provision changes which cover the transfer of employees to a buying company. Case law.
