Following the UK Government?s failure to implement a comprehensive review of compulsory purchase law, focuses on three cases where the courts have tried to deal with the problems of compulsory purchase by implementing many of the Law Commission?s proposals in this area by case law. Provides detailed discussion of: Moto Hospitality Ltd v Secretary of State for Transport (see L140296); Greenweb Ltd v Wandsworth LBC (see L142572); Spierose Ltd v Transport in London (L145181). Concludes that the outcomes show the limits of the courts ability to change established and statute case law principles.
