Examines the recent ruling in Newham LBC v Thomas-Van Staden ((2008) EWCA Civ 1414) on whether a fixed-term business tenancy which provided for a period of holding over could be said to be a tenancy granted "for a term of years certain" as required by the Landlord and Tenant Act 1954 S38(4) for a tenancy to be contracted out of the provisions of S24-28 of the Act. Notes the repeal of S38(4) by the Regulatory Reform (Business Tenancies) (England and Wales) Order 2003 and considers whether the position would nevertheless be the same under the new S38A.
