Previously, this had been done by forming an owners' association in the form of a club or trust, however the Title Conditions (Scotland) Act 2003 (Development Management Scheme) Order 2009, which came into force on 1 June 2009, allows DMSs to be formed through the registering of a Deed of Application in the Property Register.
