[2010] EWHC 358 (Ch) 3 March 2010. Considers whether the plaintiff retailer tenants F and others had been misled by information provided by the respondent developer B when they agreed their leases, which turned out to be a commercial disaster for them. F claimed that B misrepresented the business viability of the site in its brochures, in particular the extent of motorway signage, the likely footfall and the site facilities. Held: the landlord developer was not guilty of fraudulent misrepresentation. B had no reason to doubt the information commissioned by them from a reputable economic analyst Roger Tym & Partners to put in their marketing brochures.
