[2010] EWHC 2084 (Ch), 4 August 2010. Considers for the first time whether a business tenant can bring forward a hearing date to stop a landlord being able to oppose a lease renewal. Claimant (SO) sought summary judgment to allow it to progress its lease renewal after landlord (SP), refusing to grant the renewal, went into administration before reaching a trial date for its plans to redevelop the site. "Held": Not allowed. SO's case would complicate future lease renewals. A summary judgment hearing was not a final hearing and it made no sense to consider the matter at such an early stage.
