The tribunal decided that they should not. Held, after considering the Dairy Produce Quota Regulations 1984 and EC Council Regulations, particularly Regulation 804/68 article 5c(2) and Regulation 857/84 article 6(1), that the brought in milk should not be taken into account when determining quota. If H had been dealing only with milk which had been brought in it would not have been taken into account and any case milk brought in should be taken into account in the determination of someone else`s quota.
