The applicant (M) acquired a shop with living accommodation over at Beaumaris in the Isle of Anglesey, using the right to buy provisions of the Housing Act 1985. M covenanted with the borough council in terms of s57 of the Act not to dispose of the property save to a person who for three years had his place of work or principal home in Gwynedd. M sought the discharge of the covenant under LPA 1925 s84(1) para (aa). Application dismissed. There was considerable doubt as to whether the covenant was a restrictive covenant falling within the jurisdiction conferred on the tribunal by the 1925 Act s84(1).
