In this case the parties disputed the date by which the contractor had achieved practical completion. It was decided on appeal in TCC in favour of Skanska, practical completion being 'deemed' to have taken place at the earlier date. The judgment centred on the interpretation of cl17. Suggests that JCT should amend cl17 following this decision and examines the ICE Conditions of Contract 7th Edition cl48(3) to see how it could be affected.
