Appeal by M against a decision refusing an application to him under the Land Compensation Act 1961 s21 for an order quashing SoS Environment`s decision that land compulsorily acquired by K would have been given planning permission for car parking and the intended road only. "Held" that the rules in the Land Compensation Act 1961 s5 requiring assumption of a sale on the open market played no part in the decision. Also, SoS Environment clearly rejected the proposal for planning permission for built development because of the loss of potential open space. Appeal dismissed. | ||
