A asserted that there had been an assured shorthold tenancy of a flat of which A was owner or part owner, and that appropriate notice had been given under the Housing Act 1988. Notice had been given due to rent arrears, and claimed the tenant refused to leave. A changed the locks and put the possessions into the street. The tenant was readmitted to the flat and A was told the tenant would seek an injunction if there was further harassment. Tenant left the property and commenced proceedings under Housing Act 1988 s27. A did not defend the claim and judgment was issued for default; A took no action. Damages were ordered and A appealed. Appeal upheld in part. | ||
