Plaintiff`s appeal for an extension of time under the Latent Damage Act 1986 was refused, on the grounds that they had enough knowledge in 1988 to start negligence proceedings against defendant surveyors over an alleged inaccurate and misleading valuation report carried out in 1984. Therefore the 3 year rule applied, upholding the Limitation Act 1980.
