The application was dismissed because the reference was misconceived; one of the main reasons being: that the claimant could not bring himself within the definition of relevant interest, and therefore was not entitled to claim compensation under para 4(4) which was the only relevant provision of the Telecommunciations Code conferring jurisdiction on the Lands Tribunal.
