B claimed that the LT had no jurisdiction to determine the case and W was estopped from this additional claim by his county court action for professional fees in connection with this matter. Held, that although the notice to treat had not been withdrawn in accordance with s31 there was no reason why W should not enter an agreement with B to withdraw the notice on payment of such compensation as would have been due under s31. The decision was within the LT authority. Also held that the county court decision had not affected this claim. | ||
