520 _aThis analysis relates to the Consultation on Amendments to the Scheme for Construction Contracts (England and Wales) Regulations 1998. That consultation sought views on amendments to the Scheme following the enactment of Part 8 of Local Democracy, Economic Development and Construction Act 2009. The 2009 Act made some important changes to the payment regime, to the right to submit a dispute to adjudication and to the right to suspend performance of a construction contract because of non-payment. Respondents came from across the industry including trade associations representing SMEs in construction supply chains, as well as those who provide dispute resolution services to it.
