They had negotiated a 10% discount on the purchase price but C instructed that only 8% to be shown on the contracts, the remaining 2% being invoiced as a finder's fee and being the subject of a separate agreement. C and Q refused to complete after respondent N had served delayed notices of completion and resisted N's subsequent application for specific performance.The court found for N who contended that the finder's fee was not a term of any of the contracts. Held: appeal dismissed. The judge was correct in concluding that the finder's fee did not form part of any of the contracts. | ||
