520 _aCA 19 February 1988 Appeal against conviction brought by eight appellants prosecuted on indictment for using land in contravention of an enforcement notice . Planning permission was granted in 1973 for an egg packing business and for servicing etc motor vehicles used in that business. On the failure of the business, the land was used, without further planning permission, for a number of different businesses in the motor trade . The planning authority served enforcement notices on the appellants and they appealed to the SOS under Town and Country Planning Act 1971 s88 . By s88(10) an enforcement notice was, pending final determination or withdrawal of an appeal under s88, of no effect. SOS dismissed the appeals and the appellants appealed to the High Court under s246 of the 1971 Act. SOS reheard the appeals under s88 and upheld the enforcement notices. The second appeal by the appellants to the High Court was dismissed but leave was given to appeal to CA. Notice of appeal was given on
