520 _aA paper presented at the COBRA Conference in New Delhi on 10-12 September 2013. Looks at private enforcements as an effective tool in the fight against cartels. It can serve both compensating and deterring functions, and successfully unburden public authorities. The ECJ?s case law prepared foundation for the European model of private enforcement. As private suits in competition cases are not very common in Europe, sparse case law provides valuable deliberations on substantive nevertheless still unresolved, legal matters. It also contains guidelines on successful application of private enforcement.
