The ruling in the "Homebase Ltd and another v Allied Dunbar Assurance plc" ([2002] EWCA Civil 666, Abs65740) had also affected one in five businesses' plans to sublet. The court had ruled in favour of Allied Dunbar, stating that a tenant could not sublet at below the original passing rate without the landlord's consent.
