520 _aDescribes how companies and individuals can be held liable for water pollution caused by the actions of others. Under the Water Resources Act 1991 s85 and the Groundwater Regulations 1998, companies and individuals can be fined for accidental spillages from vehicles and on-site accidents that pollute streams, rivers and other controlled waters and for leachate from landfill sites. This is illustrated by the case "Express Ltd v Environment Agency ([2004] EWHC 1710 (Admin)) where liability was imposed on a third party that was not directly responsible for the pollution.
