| 520 | _aChD 23 June 1987. The freehold of the football ground had always been held by the borough council and had been occupied by the club since 1888. The Club had erected various buildings at its own expense. Various short leases were granted at small but steadily rising rents. By 1969 the club had prospered and wished to make further improvements to the ground. A new lease of 99 years was drawn up to give the club security in the premises. When the first rent review arose after 14 years the question arose as to whether it should include a rent for the buildings on the ground bearing in mind they had been financed by the club. It was held that the construction of the rent review clause was such that it required the rent to be fixed by determining the current market rental value of the land on the hypothosis that it is free of building, despite the judgment in Goh Eng Wah v Yap Phooi Yin and others .
