520 _aOn 21 March 2024, Mr Justice Zacarroli delivered a judgment in the ChD. An individual who had a secure tenancy of a council flat wanted to exercise their right to buy under the Housing Act 1985 s.118 after not being in residence for a long period, their intention to return to the property as their only home, even though that was to happen only once they had exercised their right to buy the property, was sufficient to satisfy the tenant condition in s.81.
