The lessee argued that the clause provided for an upwards only rent review on the first review and on subsequent reviews could be increased or reduced subject to a threshold provision. The lessor argued that the clause provided for an upwards only rent review on each review i.e. a ratchet provision. The ChD judge decided in favour of the lessor`s interpretation. Lessee`s appeal dismissed.
