Appeal by defendant tenant against previous decision holding that a notice to quit issued by the plaintiff landlords was effective to terminate the defendant`s tenancy of a public house .The landlord had underlet the tenancy for a term of three years. On expiry, the defendant held over as a tenant from year to year. The tenancy agreement provided for termination by 6 months` notice, but with a further provision for termination, in the event of the tenant`s death, by a notice of not less than 14 days or, if the tenant left a widow, by a notice not expiring earlier than 3 months after the date of the tenant`s death. The landlords gave a 6 months` notice to quit, which the tenant contested, claiming that under the provisions of the Law of Property Act 1925 s 149(6) , the term granted to him by the tenancy agreement had been converted into one for 90 years determinable by notice after his death. This claim had been rejected by the previous judge. CA agreed, and held that | ||
