520 _a"Hamble Parish Council v Haggard and another" ChD 17 July 1991, concerned the granting of a right of way to a churchyard extension made to the vicar and successors in title. The land was passed to Hamble Parish Council by pastoral decree. Thereafter the churchyard became a public burial ground. Defendant landowner argued that they had not anticipated that the use would be excessive. Declared that the plaintiffs were entitled to a right of way. Injunctive relief refused. See also WB2740-20.
