In dismissing an appeal by the defendant against a summary judgment under Order 14 that the contract had been frustrated due to the requirements of highways authorities to carry out road repairs, it was held that the contract had not been frustrated by the reqiurements of the highway authority. Moreover, the highway authorities requirements had not caused the delay in obtaining entry to the land.
