| 520 | _aQBD 20 October 1988 Application under Land Acquisition Act 1981 s23 by (B) to quash a cpo confirmed by the SOS. The order followed a period of conflict between B and the housing authority. B had obtained planning permission to convert a house into three self-contained flats and had received an improvement grant which was later withdrawn. As the conversion proceeded, existing tenants left, with the exception of the Gallaghers (G). Periodically the local authority intervened to protect G from the effects of the building works upon their living conditions; they were eventually rehoused. B`s challenge to the CPO was on two grounds: 1) that the order was made for reasons other than those covered by Housing Act 1985 ; 2) that no clear reasons were given for the order`s confirmation. QBD held that the inspector had asked the right question, namely, had B demonstrated a likelihood of completing the works speedily so as to produce accommodation available for letting.
