Appeal by tenant G, operating as manager and operator of a market hall with stalls let out to individual traders, against cc ruling that as G did not fulfil the occupational requirements of Landlord and Tenant Act 1954 s23(1) he was not entitled to apply for a new tenancy. CA overturned decision on the grounds that as the tenant had occupational and managerial control of the hall, the requirements of s23(1) were met and G was therefore entitled to submit a new tenancy application. Appeal allowed.
