520 _aORC 22 March 1989. M engaged contractors T to construct the main access roads across a building site. T were also subcontractors to British Telecom. M made two applications to court: 1) to discharge an order, which granted T an injunction restraining M from removing them from the site and 2) to make an order that T`s licence to occupy the premises be revoked and that they should be ordered to remove themselves from the premises after completion of their contract with BT. The dispute centred around clause 63 ICE Conditions of contract 5th edition. The present judge`s task was limited to deciding what should be done before the prime disputes were solved by an arbitrator. On consideration of the facts the judge: 1) discharged the order made by the recorder and 2) made the order requested by M, which in effect revoked T`s licence to occupy the site and restrained T, by injunction, from entering the site, except for carrying out work pursuant to their contract with BT.
