In February 1984 the claimants (R) applied to the council for planning permission to enlarge a building by erection on the roof of a penthouse flat of a class specified by Town and Country Planning Act 1971 s8 . The application was refused and an appeal by R was dismissed by the SoS Environment on 18 January 1985 which was agreed to be the valuation date. Valuation proceeded on the basis that R retained the freehold but the flat would be subject to a 125 year lease. LT held compensation to be £12,200 but declined an allowance for developers profit and risk. The appeal was dismissed on the grounds that £12,200 was the correct sum.
