In 1982 the Hackney "West Bank Housing Action Area " was declared under Housing Act 1974 s36 and in July the council issued a compulsory purchase order (cpo) covering six houses including the one in question. The applicants (S) purchased the property in September and claimed that although they were aware of the housing action area they knew nothing of the cpo since it was only sealed and published in June 1985. Objections were made to the cpo and a public inquiry was held, the report from which recommended the cpo to proceed. An application under Acquisition of Land Act 1981 s23 to quash the order was made on the basis that the owners planned to renovate the property which would achieve the council`s ends better than a cpo. This was rejected. S appealed. This was dismissed on the grounds that there was a lengthy history of disrepair for the property and at the time of the inquiry S were willing but not ready or able to carry out the repairs
