520			_aChD 16 January 1989 An originating summons by the first plaintiffs (S), who have contracted to buy land from the second plaintiffs (H), seeking a declaration under Law of Property Act 1925 s84(2) as to whether certain restrictive covenants contained in a conveyance of the land in 1894 were still enforceable and and burdened the land. ChD held that the restrictive covenants had not been annexed to the title of the original covenantee and that they were no longer enforceable. Declaration accordingly granted.
